Your consumer rights are protected. These Terms are supplementary to, and do not override, your statutory rights under the Consumer Protection Act 1999 (Act 599). Under Section 6 of the Act, no agreement can exclude or limit the rights guaranteed to you by Malaysian consumer protection law.

1. Introduction and Acceptance of Terms

These Terms and Conditions (“Terms“) govern your access to and use of smith3d.com (“Website“) and any purchase of products or services from:

Throughout these Terms, “Smith3D”, “we”, “us”, and “our” refer to Smith3D Sdn. Bhd. “You” and “your” refer to any person who accesses or uses the Website, creates an account, or places an order.

By accessing this Website, creating an account, or placing an order, you agree to be bound by these Terms, our Privacy Policy, Return & Refund Policy, and Shipping Policy. Your electronic acceptance constitutes a valid and binding agreement under Section 7 of the Electronic Commerce Act 2006 (Act 658).

If you do not agree to these Terms, you must not use this Website or place any orders.

2. Definitions

In these Terms, unless the context otherwise requires:

  • “Business Day” means Monday to Saturday, 10:00 AM – 6:00 PM MYT, excluding Malaysian public holidays.
  • “Consumer” has the meaning given under Section 3 of the Consumer Protection Act 1999 — a person who acquires or uses goods or services of a kind ordinarily acquired for personal, domestic, or household purposes, and who does not acquire such goods or services primarily for resupply, manufacturing, or commercial repair.
  • “Customer” means any person who places an order through the Website or through our Marketplace Platforms, whether or not they qualify as a Consumer.
  • “Marketplace Platforms” means third-party e-commerce platforms through which Smith3D sells products, including Shopee Malaysia, Lazada Malaysia, and TikTok Shop.
  • “Order” means any request to purchase Products or Services submitted through the Website or a Marketplace Platform.
  • “Products” means all physical goods offered for sale by Smith3D, including but not limited to 3D printers, filaments, resins, spare parts, tools, and accessories.
  • “Services” means services offered by Smith3D, including 3D printer repair, 3D printing services, technical consultations, and any other services listed on the Website.

3. Eligibility

You must be at least eighteen (18) years of age to use this Website and enter into any transaction with Smith3D. By placing an order, you represent and warrant that you have attained the age of majority as defined by the Age of Majority Act 1971 (Act 21). Contracts entered into by persons below the age of majority may be void under the Contracts Act 1950 (Act 136), Section 11.

If you are under 18, you may use this Website only with the active involvement and consent of a parent or legal guardian, who shall be bound by these Terms on your behalf and shall be responsible for all transactions conducted under the account.

4. Account Registration and Responsibilities

You may browse the Website without creating an account. However, you must register an account to place orders, leave product reviews, or access certain features.

When creating and maintaining an account, you agree to:

  • Provide accurate, current, and complete information, including your full name, email address, phone number, and billing/shipping address.
  • Maintain the confidentiality of your login credentials and not share your account with any other person.
  • Accept responsibility for all activities conducted under your account, whether or not authorised by you.
  • Notify Smith3D immediately at sales@smith3d.com if you become aware of any unauthorised use of your account or any security breach.
  • Not create multiple accounts for the same person, or create accounts on behalf of others without their authorisation.

Smith3D reserves the right to suspend or terminate any account at our discretion if we reasonably believe there has been a breach of these Terms, suspicious or fraudulent activity, or any conduct that may harm Smith3D, our customers, or third parties.

5. Products and Product Descriptions

Smith3D makes reasonable efforts to ensure that product descriptions, specifications, images, and other information on the Website are accurate and up to date. However, you should be aware of the following:

  • Display variations: Colours, dimensions, and visual appearance shown on screen may vary slightly due to differences in display settings, photography, and lighting. Product images are provided for illustrative purposes.
  • Minor differences: Actual products may differ in minor cosmetic aspects from what is shown, including packaging design, included accessories, and surface finish. Manufacturers may update product packaging, bundled accessories, or cosmetic details without prior notice to retailers.
  • Third-party brands: Products from Bambu Lab, Creality, Elegoo, Anycubic, Snapmaker, Flashforge, MINGDA, and other brands are sold as described by their respective manufacturers. Smith3D is an authorised reseller and is not the manufacturer. Product specifications, compatibility claims, and performance data are sourced from manufacturer documentation and, where stated, Smith3D’s own testing.
  • Stock availability: Product availability is subject to change. While we make every effort to keep stock information current, items may occasionally be out of stock after an order is placed. In such cases, we will notify you and offer the choice of waiting for restock or receiving a full refund.

Under Section 34 of the Consumer Protection Act 1999, goods supplied to a consumer carry an implied guarantee that they correspond with their description. Under the Trade Descriptions Act 2011 (Act 730), it is an offence to apply a false or misleading trade description to goods. Smith3D is committed to honest and accurate product representation.

6. Pricing and Currency

All prices on the Website are displayed in Malaysian Ringgit (RM / MYR) and are inclusive of applicable taxes unless expressly stated otherwise.

Prices are subject to change without prior notice. However, once an order is confirmed and payment has been accepted by Smith3D, the price at the time of purchase applies to that order.

Pricing errors: In the event of a pricing error — whether typographical, system-generated, or otherwise — Smith3D reserves the right to cancel the order and issue a full refund to the original payment method. We will notify you of the error and, where possible, offer you the option to proceed at the correct price. A pricing error may include situations where a product is listed at a price that is significantly below its known market value due to a system malfunction.

Promotional prices, flash sales, voucher codes, and discount offers are valid only for the specified period and may be subject to additional terms and conditions as stated at the time of the promotion. Promotions cannot be combined unless expressly permitted.

Shipping costs are calculated separately based on the weight, dimensions, and destination of your order, and are displayed at checkout before you confirm your payment. Please refer to our Shipping Policy for full details.

7. Payment Terms

7.1 — Accepted Payment Methods

Smith3D accepts the following payment methods for purchases made through the Website:

  • Credit and debit cards (Visa, Mastercard)
  • Online bank transfer via FPX (Financial Process Exchange)
  • Other payment methods as may be displayed at checkout from time to time

7.2 — Payment Processing

All payments are processed securely through third-party payment gateway providers. Smith3D does not store your full credit or debit card numbers on our servers. Payment processing is subject to the terms and conditions of the respective payment gateway provider.

7.3 — Payment Conditions

Payment must be received in full before your order will be processed for dispatch. Orders paid via manual bank transfer must include the order number as a payment reference. Smith3D reserves the right to cancel orders where payment has not been received or verified within 48 hours of the order being placed.

All transactions are processed in Malaysian Ringgit (MYR). If you are using an internationally issued card, any currency conversion fees or foreign transaction charges imposed by your card issuer are your responsibility.

7.4 — Marketplace Purchases

Orders placed through Shopee Malaysia, Lazada Malaysia, or TikTok Shop are processed through the respective platform’s payment systems and are governed by that platform’s payment terms and conditions. Smith3D’s direct payment terms above do not apply to marketplace transactions.

8. Order Acceptance and Processing

When you place an order on the Website, it constitutes an offer to purchase the selected products or services. An automated order confirmation email sent to you is an acknowledgement of receipt of your order — it is not an acceptance of your offer.

A binding contract between you and Smith3D is formed only when Smith3D dispatches the goods to you, or when we explicitly confirm acceptance of your order in writing (whichever occurs first). This is consistent with the principles governing formation of electronic contracts under the Electronic Commerce Act 2006 (Act 658), Sections 17–22.

Smith3D reserves the right to refuse or cancel any order at our discretion, including but not limited to the following circumstances:

  • The product is out of stock or has been discontinued
  • A pricing or product description error has been identified
  • We are unable to verify or process your payment
  • We suspect fraudulent, illegal, or unauthorised activity
  • You have breached these Terms or any other Smith3D policy
  • The order exceeds reasonable household quantity limits, suggesting possible reselling

If we cancel your order, you will receive a full refund to your original payment method. We will make reasonable efforts to notify you of the cancellation and the reason for it.

Processing Hours

Orders are processed during business hours: Monday to Saturday, 10:00 AM – 6:00 PM MYT. Orders placed and paid for before 2:00 PM MYT on a Business Day are typically processed and dispatched on the same day, subject to stock availability. Orders placed after 2:00 PM, on Sundays, or on Malaysian public holidays are processed on the next Business Day.

Pre-Orders and Backorders

For pre-order or backorder items, estimated availability dates are provided on the product page but are not guaranteed. These dates depend on manufacturer supply timelines which are beyond Smith3D’s control. We will notify you of any significant delays and offer you the option to continue waiting or receive a full refund.

9. Order Cancellation

9.1 — Cancellation by Customer

You may request cancellation of your order at any time before the order has been dispatched by contacting Smith3D via:

Once an order has been marked as shipped or dispatched, it can no longer be cancelled. In such cases, please refer to our Return & Refund Policy.

9.2 — Cancellation by Smith3D

Smith3D may cancel orders under the circumstances described in Section 8 above. In all such cases, you will receive a full refund to your original payment method.

9.3 — Marketplace Orders

Cancellation of orders placed through Shopee, Lazada, or TikTok Shop must be initiated through the respective platform’s cancellation procedure. Each platform has its own cancellation window and policies which take precedence for transactions conducted on that platform.

10. Intellectual Property

All content on the Website — including but not limited to text, graphics, logos, product photographs, videos, page layouts, software code, and the Smith3D brand identity — is the property of Smith3D Sdn. Bhd. or its respective licensors, and is protected by Malaysian intellectual property laws, including the Copyright Act 1987 and the Trademarks Act 2019.

Third-party trademarks displayed on this Website — including Bambu Lab, Creality, Elegoo, Anycubic, Snapmaker, Flashforge, MINGDA, and any other brand names, logos, or marks — are the property of their respective owners. Their display on this Website is solely for the purpose of identifying products offered for sale and does not imply any endorsement, affiliation, or sponsorship beyond Smith3D’s status as an authorised reseller and dealer.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or republish any content from this Website without prior written consent from Smith3D, except as permitted by applicable law (such as fair dealing provisions under the Copyright Act 1987).

By submitting product reviews, photographs, testimonials, or other user-generated content to the Website, you grant Smith3D a non-exclusive, royalty-free, worldwide, perpetual licence to use, display, reproduce, and adapt such content for marketing, promotional, and operational purposes across our Website, social media channels, and Marketplace Platforms.

11. Limitation of Liability

Important: Nothing in these Terms shall exclude or limit Smith3D’s liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability which cannot be excluded or limited under the Consumer Protection Act 1999 or any other applicable Malaysian law. Under Section 6 of the CPA 1999, consumer rights guaranteed by the Act cannot be contracted out. Under Section 71, product liability for defective products cannot be excluded by contract.

Subject to the paragraph above, Smith3D’s total aggregate liability to you for any claim arising from or related to a purchase or your use of the Website shall not exceed the total amount you paid to Smith3D for the specific product or service giving rise to the claim.

To the fullest extent permitted by law, Smith3D shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or loss of goodwill;
  • Damages resulting from misuse, improper installation, unauthorised modification, or failure to follow manufacturer instructions when operating products purchased from Smith3D;
  • Variations in 3D printing outcomes — product performance depends on user skill, printer settings, environmental conditions (temperature, humidity), filament/resin quality, and proper maintenance. Smith3D does not guarantee specific print results;
  • Delays or failures in performing our obligations caused by events beyond our reasonable control (see Force Majeure below).

Force Majeure

Smith3D shall not be liable for any failure or delay in performing any obligation under these Terms if such failure or delay results from causes beyond our reasonable control. This includes, but is not limited to: natural disasters, floods, fire, pandemic, epidemic, government orders or restrictions, supply chain disruptions, manufacturer production delays, courier service failures, power outages, internet or telecommunications failures, labour disputes, or war.

12. User Conduct

When using the Website, you agree not to:

  • Use the Website for any purpose that is unlawful or prohibited by these Terms, or in violation of any applicable Malaysian law, including the Communications and Multimedia Act 1998 (Act 588) and the Computer Crimes Act 1997 (Act 563);
  • Attempt to gain unauthorised access to the Website, its servers, databases, or any connected systems;
  • Transmit any viruses, malware, or other harmful or disruptive code;
  • Use automated tools, scripts, bots, or scrapers to access, monitor, or extract data from the Website without Smith3D’s prior written consent;
  • Place fraudulent orders, use stolen payment methods, or engage in any form of payment fraud;
  • Post or transmit content that is defamatory, obscene, threatening, abusive, or that infringes the intellectual property or privacy rights of any third party;
  • Impersonate another person, entity, or Smith3D employee or representative;
  • Engage in any conduct that could damage, disable, overburden, or impair the functioning of the Website.

Smith3D reserves the right to take appropriate action against users who violate these conduct requirements, including suspending or terminating accounts, cancelling orders, and reporting suspected illegal activity to the relevant Malaysian authorities.

13. Third-Party Links and Marketplace Platforms

The Website may contain links to third-party websites, resources, or services that are not owned or controlled by Smith3D. We provide these links for convenience only and do not endorse, monitor, or assume any responsibility for the content, privacy practices, or availability of third-party websites.

Smith3D products are also available through Shopee Malaysia, Lazada Malaysia, and TikTok Shop. Purchases made through these Marketplace Platforms are subject to the respective platform’s terms of service, payment policies, buyer protection programmes, and dispute resolution mechanisms, in addition to these Terms.

In the event of a conflict between these Terms and a Marketplace Platform’s terms, the platform’s terms shall govern for transactions conducted on that platform. However, manufacturer warranty terms, product safety obligations, and Smith3D’s after-sales service commitments remain applicable regardless of the purchase channel.

14. Governing Law and Dispute Resolution

These Terms are governed by and shall be construed in accordance with the laws of Malaysia, including but not limited to the Consumer Protection Act 1999 (Act 599), Electronic Commerce Act 2006 (Act 658), Sale of Goods Act 1957 (Act 382), Contracts Act 1950 (Act 136), Trade Descriptions Act 2011 (Act 730), and Personal Data Protection Act 2010 (Act 709).

14.1 — Negotiation

Before initiating any formal proceedings, both parties agree to first attempt to resolve the dispute through direct communication and good-faith negotiation. Either party may initiate this process by sending a written notice describing the dispute to the other party. The parties shall have thirty (30) days from receipt of such notice to reach an amicable resolution.

14.2 — Consumer Tribunal

Consumer Tribunal (Tribunal Tuntutan Pengguna Malaysia / TTPM): If you are a Consumer as defined under the CPA 1999, you have the right to file a claim with the Tribunal for Consumer Claims Malaysia for disputes involving amounts up to RM50,000. Claims may be filed online at ttpm.kpdn.gov.my or at any Tribunal counter nationwide. The filing fee is RM5. You may also contact the Ministry of Domestic Trade and Cost of Living (KPDN) hotline at 1-800-886-800.

14.3 — Court Jurisdiction

For disputes that are not within the jurisdiction of the Consumer Tribunal, or for disputes involving non-consumers, the parties agree to submit to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.

15. Modifications to Terms

Smith3D reserves the right to update, amend, or modify these Terms at any time. Any changes will take effect immediately upon being posted to this page, and the “Last updated” date at the top of these Terms will be revised accordingly.

Your continued use of the Website after any changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you should discontinue use of the Website.

For material changes that significantly affect your rights or obligations — including changes to pricing policies, refund policies, or liability provisions — Smith3D will make reasonable efforts to notify registered customers via email before the changes take effect.

The current version of these Terms supersedes all previous versions.

16. General Provisions

16.1 — Severability

If any provision of these Terms is found by a court or tribunal of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

16.2 — Entire Agreement

These Terms, together with the Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and Smith3D regarding your use of the Website and your purchase of products and services.

16.3 — Waiver

No failure or delay by Smith3D in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. A single or partial exercise of any right shall not preclude any further exercise of that right or the exercise of any other right.

16.4 — Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without Smith3D’s prior written consent. Smith3D may assign its rights and obligations under these Terms to any successor entity, affiliate, or in connection with a merger, acquisition, or sale of all or substantially all of its assets, without your prior consent.

16.5 — Language

These Terms are published in the English language. In the event of any inconsistency between the English version and any translation provided, the English version shall prevail.
